Terms of Use
1. Acceptance of Terms
By downloading, installing, or using Lulla ("the App"), you agree to be bound by these Terms of Use ("Terms").
If you do not agree to these Terms, please do not use the App.
2. Description of Service
The App provides relaxing audio content and tools intended for personal rest and well-being, including:
- A library of sleep sounds, soundscapes, and lullabies
- Mixing and layering of multiple sounds
- Sleep timers with fade-out
- Optional background audio playback
The App is provided for personal, non-commercial use only.
3. No Medical Claims
Lulla is not a medical device and is not a substitute for professional medical, psychological, or therapeutic advice.
- The App does not diagnose, treat, cure, or prevent any condition, including insomnia or other sleep disorders
- If you experience persistent sleep problems, please consult a qualified healthcare professional
- Do not use the App while driving or operating heavy machinery
4. User Responsibilities
You agree to use the App only in compliance with applicable laws and these Terms.
You are responsible for:
- Ensuring safe listening volumes to protect your hearing
- Using the App at safe times (not while driving, operating machinery, or in any situation that requires full attention)
- Supervising minors who use the App on your device
5. Advertising
The App is supported by third-party advertising (including Google AdMob).
By using the App, you acknowledge that:
- Ads will be displayed during normal use
- Some ads may be personalized based on your device's advertising identifier, subject to the choices you make through App Tracking Transparency (iOS) or Google Ads settings (Android)
- We are not responsible for the content, accuracy, or practices of any advertised products or services
6. Subscriptions and Payments
The App may offer premium features through auto-renewable subscriptions (for example, to remove advertising or unlock additional content).
- Payment will be charged to your Apple ID or Google account at confirmation of purchase
- Subscriptions automatically renew at the same price unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Apple ID or Google account settings
Free Trials (if applicable)
- Any unused portion of a free trial will be forfeited when purchasing a subscription
7. Refund Policy
All purchases are handled by the platform provider (Apple App Store or Google Play).
- Refund requests must be submitted directly to the respective platform
- We do not process payments or refunds directly
8. Intellectual Property
All rights, title, and interest in the App, including its design, code, audio content, artwork, and branding, are owned by Dmytro Antonenko or licensed to us.
You may not:
- Copy, modify, redistribute, or resell the App or its audio content
- Reverse engineer, decompile, or attempt to extract source code
- Extract audio files for use outside the App
- Use the App or its content for commercial purposes without written permission
9. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, solely for your personal, non-commercial use, and subject to these Terms and the terms of the Apple App Store or Google Play.
10. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided "as is" and "as available"
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for any indirect, incidental, special, or consequential damages, including loss of sleep, loss of data, hearing damage from misuse, or interruption of service
11. Third-Party Services
The App includes third-party services, including but not limited to:
- Google AdMob (advertising)
- Firebase Analytics and Crashlytics (analytics and crash reporting)
- Apple App Store and Google Play (distribution and payments)
We are not responsible for the content or practices of third-party services. Your use of those services is governed by their own terms and privacy policies.
12. Apple-Specific Terms
If you are using the App on an Apple device, the following also applies:
- These Terms are between you and Dmytro Antonenko, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support for the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation
- Apple is not responsible for addressing any claims by you or any third party relating to the App
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
13. Google Play-Specific Terms
If you are using the App on an Android device obtained through Google Play:
- These Terms are between you and Dmytro Antonenko, not Google
- Your use of the App must also comply with the Google Play Terms of Service
- Google is not responsible for the App, its content, or any support related to the App
14. Dispute Resolution
Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations.
If no resolution is reached, disputes shall be subject to the jurisdiction of the courts of Ukraine.
15. Termination
We reserve the right to suspend or terminate access to the App at any time, without notice, if these Terms are violated or required by law.
You may stop using the App at any time by uninstalling it.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be reflected by a new "Effective date" at the top of this document.
Continued use of the App after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-laws principles.
